Since 2013, Georgia has started the process of liberalization of criminal law, which was reflected in the abolition of Assembly of punishment rules. There is the question that along with any positive result will there be a negative one by prevailing an absorption principle.
As a problem still remains a subject, how often are the alternative sentences used in judicial practice (example: sentences, which are not related to deprivation of liberty) and how effectively they do work.
Code liberalization should go in several ways through: 1) Individual acts decriminalization, in terms of both the legislative and judicial enforcement; 2) Sentences liberalization, by improvement of alternative sentencing; 3) Sentences liberalization in the sense that it be proportional to the seriousness of the offense; 4) liberalization of sentence in terms of sentencing, the court should be given more opportunity to pursue the principle of individualization. Also the use of conditional sentences should be expanded, which are so limited by legislative changes since 2004.
